Know your rights

Most patients have no idea how much the law is already on their side. Pick your state to see the protections that apply where you live — on top of the federal rules below.

Federal protections (apply everywhere)

No Surprises Act (2022)

Bans most surprise out-of-network bills for emergency care, air ambulance services, and out-of-network providers at in-network hospitals. If you get a bill for more than your in-network cost-share for one of these, you can dispute it through the federal IDR process — and you have 120 days to do it.

Hospital Financial Assistance (Charity Care)

Every nonprofit hospital is required by IRS §501(r) to publish a written Financial Assistance Policy and offer free or discounted care to qualifying patients — typically anyone under 200–400% of the Federal Poverty Level. They must screen you BEFORE sending you to collections.

Right to an Itemized Bill

You can request an itemized statement (line-by-line, with CPT/HCPCS codes) at any time. Hospitals must provide it. Always request one before paying — 30–80% of hospital bills contain billing errors.

Good Faith Estimate

If you're uninsured or paying out of pocket, you have the right to a written estimate of expected charges at least 1 business day before a scheduled service. If the final bill is $400+ over the estimate, you can dispute it.

Balance Billing Limits

Many states (CA, NY, TX, FL, IL and others) have their own balance-billing laws that go further than federal rules — including for ground ambulance, which the No Surprises Act does NOT cover. Check your state's Department of Insurance.

Insurance Appeal Rights (ACA)

Under the Affordable Care Act you have the right to appeal any denied claim — first internally with your insurer, then to an Independent External Review. Over 50% of appeals succeed. Deadlines are typically 180 days from the denial.
